Rights and Duties for a Foreigner to Buy Land in Peru
Rights
Any foreigner can buy land, houses, or apartments in Peru, even as a tourist. No residency, Peruvian ID, or tax number is required to purchase. A valid passport is sufficient, and you only need a permit to sign contracts issued by Migraciones. Foreigners have the same property rights as Peruvians, including the right to sell, rent, mortgage, and inherit. You may grant a consular power of attorney so someone in Peru can sign on your behalf.
Important Restriction
There is a constitutional ban on buying near borders. Foreigners cannot buy land located within 50 kilometers of Peru's borders unless they obtain special authorization from the Peruvian State under Article 71 of the Constitution.
Duties and Obligations
If you are in Peru as a tourist, you must request the permit to sign contracts before signing the purchase documents. You must show proof of the lawful source of funds used for the purchase under anti-money laundering rules. The buyer must follow the legal purchase process by signing the purchase agreement and public deed before a notary, registering the property with SUNARP, and using formal banking methods for payment. The buyer is responsible for paying applicable taxes, including alcabala tax when applicable, as well as notary and registry fees. You must respect municipal regulations regarding land use, construction rules, zoning, and building permits.
